1. About the CASA Archive
The CASA Archive ("Archive") is an online platform operated by the Contemporary A Cappella Society of America ("CASA," "we," "us," or "our"). The Archive allows a cappella groups, artists, and individuals to submit audio recordings and video recordings for inclusion in the Archive and for consideration in our awards and compilation programs, including:
- Contemporary A Cappella Recording Awards (CARAs)
- A Cappella Video Awards (AVAs)
- The sing! Compilation
These Terms govern your access to and use of the Archive website and all related submission processes (collectively, the "Services").
2. Eligibility and Account Registration
2.1 Eligibility
You must be at least 18 years of age, or the age of majority in your jurisdiction, to create an account and submit materials. If you are submitting on behalf of a group or organization, you represent that you have the authority to bind that group or organization to these Terms.
2.2 Account Creation
To access certain features of the Services, you must create an account. When registering, you agree to:
- Provide accurate, current, and complete information;
- Maintain and promptly update your account information;
- Keep your password confidential and secure;
- Notify us immediately at support(at)casa.org if you suspect unauthorized access to your account; and
- Accept responsibility for all activity that occurs under your account.
CASA reserves the right to suspend or terminate accounts that contain inaccurate, incomplete, or fraudulent information.
3. Submissions to the Archive
3.1 What You May Submit
You may submit audio recordings and video recordings of a cappella performances ("Submissions") for inclusion in the Archive and/or for consideration in the CARAs, AVAs, and the sing! Compilation, subject to the eligibility requirements and guidelines for each program as posted on the Archive website.
3.2 Your Representations and Warranties
By submitting any material to the Archive, you represent and warrant that:
- You are the copyright owner of the Submission, or you have obtained all necessary rights, licenses, consents, and permissions from all rights holders — including performers, songwriters, publishers, and any other third parties — to submit the material and grant the rights described in these Terms;
- The Submission does not infringe any copyright, trademark, right of publicity, privacy right, or any other intellectual property or proprietary right of any third party;
- If the Submission is a recording of a cover song or arrangement of a copyrighted work, you have obtained or will obtain the necessary mechanical licenses, synchronization licenses (for video), and any other required permissions;
- The Submission does not contain any content that is unlawful, defamatory, obscene, or otherwise objectionable;
- You have obtained written consent from all individuals who appear in or can be identified from any video Submission, including consent to the uses described in these Terms; and
- All information provided in connection with the Submission (group name, member information, eligibility details, etc.) is accurate and complete.
3.3 License Grant to CASA
By submitting materials to the Archive, you grant CASA a non-exclusive, worldwide, royalty-free, sublicensable license to:
- For all Submissions: Host, store, display, stream, and make available the Submission on the Archive website and related CASA platforms for archival and educational purposes; reproduce and distribute the Submission in connection with CASA's programs and promotional materials; and use the names, likenesses, and biographical information of the artists and groups associated with the Submission for promotional and informational purposes.
- For Submissions entered in the CARAs or AVAs: Reproduce, stream, and share the Submission in connection with the judging process, awards ceremonies, announcements, and promotional activities related to the CARAs or AVAs; and identify the Submission and its creators as nominees, winners, or participants in CASA promotional materials.
- For Submissions selected for the sing! Compilation: Reproduce, distribute, sell, and digitally distribute the Submission as part of the sing! Compilation release in any format now known or hereafter developed, including physical and digital distribution.
This license does not transfer ownership of your Submission. You retain all copyright and other intellectual property rights in your Submission.
3.4 Archive Inclusion
CASA makes no guarantee that any Submission will be included in the Archive or selected for any awards program or compilation. CASA reserves the right, in its sole discretion, to decline to include or remove any Submission that violates these Terms, infringes third-party rights, or is otherwise deemed inappropriate.
4. Fees and Payments
4.1 Submission Fees
Certain programs — including some or all of the CARAs, AVAs, and sing! Compilation — may require payment of a submission fee. Current fees are posted on the relevant program pages of the Archive website. Fees are subject to change at CASA's discretion, with any changes taking effect upon posting.
4.2 Payment Processing
Payments are processed by third-party payment processors. By submitting payment information, you authorize us and our payment processor to charge the applicable fees to your designated payment method. You represent that you are authorized to use the payment method provided.
4.3 Refund Policy
Submission fees are generally non-refundable once a submission has been received and accepted for consideration. If a program is cancelled by CASA before judging commences, CASA will issue a full refund of submission fees paid for that program. Please review the specific program guidelines for any additional refund terms.
5. Intellectual Property
5.1 CASA's Intellectual Property
The Archive website, including its design, text, graphics, software, and all content created by CASA (excluding User Submissions), is owned by or licensed to CASA and is protected by applicable intellectual property laws. You may not reproduce, modify, distribute, or create derivative works from CASA's content without our prior written consent.
5.2 Copyright Infringement
CASA respects intellectual property rights. If you believe that any content on the Archive infringes your copyright, please contact us at support(at)casa.org with the information required under the Digital Millennium Copyright Act (DMCA). CASA will respond to valid DMCA takedown notices in accordance with applicable law.
6. Prohibited Conduct
You agree not to:
- Submit materials you do not have the right to submit or that infringe third-party rights;
- Provide false, misleading, or fraudulent information in connection with any Submission or account;
- Attempt to manipulate the judging process for any CASA program;
- Use the Services to transmit spam, malware, or other harmful content;
- Attempt to gain unauthorized access to the Archive, other users' accounts, or CASA's systems;
- Use automated means (bots, scrapers, etc.) to access or collect data from the Archive without CASA's written permission; or
- Engage in any conduct that disrupts, damages, or impairs the functioning of the Services.
7. Disclaimers
THE ARCHIVE AND ALL SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, CASA DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. CASA DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. YOUR USE OF THE SERVICES IS AT YOUR OWN RISK.
8. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, CASA AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL — ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL CASA'S TOTAL LIABILITY TO YOU EXCEED THE AMOUNT OF FEES PAID BY YOU TO CASA IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you.
9. Indemnification
You agree to indemnify, defend, and hold harmless CASA and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Services; (b) your Submissions; (c) your breach of these Terms; or (d) your violation of any third-party rights, including intellectual property rights.
10. Termination
CASA may suspend or terminate your account and access to the Services at any time, with or without notice, for any reason, including if CASA believes you have violated these Terms. Upon termination, your right to use the Services will immediately cease. Sections 3.3, 5, 7, 8, 9, 11, and 12 of these Terms will survive any termination.
11. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of California, without regard to its conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Services shall be resolved exclusively in the state or federal courts located in San Francisco County, California, and you consent to personal jurisdiction in those courts.
12. General Provisions
12.1 Changes to These Terms
CASA may update these Terms at any time. We will notify registered users of material changes by email or by posting a notice on the Archive website. Your continued use of the Services after the effective date of any changes constitutes your acceptance of the updated Terms.
12.2 Entire Agreement
These Terms, together with our Privacy Policy and any program-specific guidelines, constitute the entire agreement between you and CASA regarding the Services and supersede any prior agreements.
12.3 Severability
If any provision of these Terms is found to be unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.
12.4 Waiver
CASA's failure to enforce any right or provision of these Terms will not constitute a waiver of that right or provision.
